Waiver of Benefit Overpayment - PUA, PEUC or FPUC
A request for waiver is available for non-fraud overpayments of benefits for Pandemic Unemployment Assistance (PUA), Pandemic Emergency Unemployment Compensation (PEUC), and Federal Pandemic Unemployment Compensation (FPUC).
A waiver is a request to "waive" your non-fraud overpayment. You can request a waiver if you are unable to pay back the overpayment due to financial hardship. If the waiver is granted, then your overpayment is forgiven.
You may have received a waiver form in the mail or, if you are on PUA, in your portal.
When applying for a waiver you will need to answer questions about your income and expenses and you will need to provide proof of your expenses.
Philadelphia Legal Assistance has made an online form to make things easier for you. This form can be used to submit your waiver request and documentation to the PA Department of Labor & Industry.
Fill out the waiver request on the Philadelphia Legal Assistance website at:
Waiver Request - http://philalegal.org/waiver
You will receive a determination in the mail about whether the waiver has been granted in your case.
REMINDER: Waiver is only available for non-fraud overpayments of federal benefits.
